Welcome to Bara AI! These Terms of Service (“Terms”) govern your access to and use of the Bara AI platform and services. By accessing or using our services, you agree to be bound by these Terms.
1. Services Provided
Bara AI provides a done-for-you AI and media service that provisions accounts on our platform for customers. Customers may connect their own services or allow Bara AI to securely connect them. Additionally, customers may securely upload all media to the platform for our processing. No data or media needs to be transmitted outside the platform.
2. Account Setup and Security
Bara AI will provision accounts on the platform for customers. During the setup, customers may either connect their own services or provide authorization for Bara AI to handle the secure integration of their services. All data and media uploads are managed securely through the platform.
Customers are responsible for maintaining the confidentiality of their account information, including login credentials, and for all activities that occur under their account. Bara AI is not liable for any loss or damage arising from unauthorized access or use of your account.
3. Subscription and Billing
The Bara AI service operates on a month-to-month subscription model. Customers will be billed monthly in advance for the use of the platform and associated services. All fees are non-refundable, and no refunds will be issued for partial months of service or unused features.
4. Modifications to Service and Pricing
Bara AI reserves the right to modify the services offered and pricing at any time. We may modify these Terms without providing notice to you. Your continued use of the service after such modifications constitutes your acceptance of the modified terms.
5. Service Level Agreement (SLA)
Bara AI offers a tiered maintenance and response service depending on the customer’s selected subscription level. The specific response time and support coverage depend on the chosen plan. The details of the SLA can be found in your subscription agreement.
6. Media Uploads and Data Management
Customers may securely upload media files to the Bara AI platform for use in their service workflow. Bara AI ensures that all uploads and data transfers are securely encrypted and stored on the platform. Bara AI will not access, disclose, or share your uploaded content unless required to provide the requested services or comply with legal obligations.
7. Termination and Cancellation
Either party may terminate the service at any time. Upon cancellation, customers will not be eligible for any refunds for the current or previous billing periods. If you cancel, you will continue to have access to the platform through the end of your current billing cycle.
Bara AI reserves the right to suspend or terminate access to the platform if a customer violates these Terms or engages in activities that harm the platform or other users.
8. Intellectual Property
All content, software, and technology on the Bara AI platform are the property of Bara AI or its licensors. You are granted a limited, non-exclusive, non-transferable license to use the platform for the purposes of receiving services, subject to these Terms.
You retain ownership of all media and content you upload to the platform, but you grant Bara AI a license to use this content as necessary to provide the services.
9. Liability and Indemnification
To the fullest extent permitted by law, Bara AI and its affiliates, officers, directors, employees, and agents shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly, or any loss of data, use, goodwill, or other intangible losses, resulting from your use of the platform.
You agree to indemnify and hold Bara AI harmless from any claims, damages, liabilities, and expenses (including attorneys' fees) arising from your use of the service, violation of these Terms, or violation of any rights of a third party.
10. Modifications to Terms
Bara AI reserves the right to modify these Terms at any time without prior notice. It is your responsibility to review the Terms regularly. Continued use of the service following any changes constitutes acceptance of the modified Terms.
11. Governing Law and Dispute Resolution
These Terms are governed by the laws of Arizona. Any disputes arising from these Terms or your use of the service will be resolved through binding arbitration in accordance with the rules of the Phoenix, Arizona. By agreeing to these Terms, you waive your right to a jury trial or to participate in a class-action lawsuit.
